Notice of Hearing

Pursuant to K.S.A. 2-2117, a public hearing will be conducted at 10:00 a.m. June 30, 2021, in room 124, Kansas Department of Agriculture (“KDA”), 1320 Research Park Dr., Manhattan, KS 66502, regarding the issuance of a permanent statewide quarantine of all weed species designated noxious by federal regulation 7 CFR 360.200. The proposed quarantine would replace KDA’s existing Federal Noxious Weed Quarantine, which is expiring, and would prohibit all movement of items regulated pursuant to the quarantine into or within the State of Kansas. Regulated items under the quarantine would include entire plants and all parts of plants of any federally designated noxious weed capable of growing or propagating, as well as forage, hay, or any other commodity containing any such plants or plant parts.

All interested persons may attend the hearing in person or appear by counsel and will have the opportunity to express comments orally, in writing, or both. Written comments and requests for information concerning the proposed quarantine should be directed to Jeff Vogel, Plant Protection and Weed Control Program Manager, Kansas Department of Agriculture, 1320 Research Park Dr., Manhattan, KS 66502, email jeff.vogel@ks.gov, at or before the time of hearing. A copy of the proposed quarantine may be accessed at https://agriculture.ks.gov/document-services/public-comment. Comments may also be made on KDA’s website. For persons intending to present oral comments at the hearing, prior notice to KDA would be helpful in arranging the agenda and may be provided using any of the contact information contained in this notice. In order to ensure all parties are able to comment, it may be necessary to limit each participant’s oral presentation to five minutes.

Anyone with a disability may request accommodation in order to participate in the public hearing and request a copy of the quarantine in an accessible format.
